What is a chapter 7 Bankruptcy case and how does it work?

A chapter 7 bankruptcy is that part of the Bankruptcy code that deals with liquidation. A chapter 7 bankruptcy allows a debtor, who is unable to pay his or her creditors, to resolve his or her debts through the division of his or her non-exempt assets among his or her creditors. Creditors are required to comply with the bankruptcy code and must stop the following actions: harassing collection calls, garnishment of wages, pursuit of judgments through lawsuits, repossession and foreclosure. After a bankruptcy proceeding is filed, creditors are prohibited from trying to collect outside of the proceeding. If you are represented by an attorney, creditors must contact the attorney with questions regarding any debts.

In a chapter 7 bankruptcy case you will need to go to a proceeding called the "meeting of creditors" to meet with the bankruptcy trustee and any creditor who chooses to come. Most of the time, this meeting will be a short and simple procedure where you are asked a few questions about your bankruptcy forms and your financial situation.

In four to six months from the date of filing the bankruptcy, if all the requirements for discharge are met, the judge will sign a discharge order. Creditors are forbidden from attempting to collect discharged debts.

What is a chapter 7 discharge?

A discharge is a court order releasing a debtor from all of his or her dischargeable debts and ordering the creditors not to attempt to collect them from the debtor.

What debts are dischargeable?

Chapter 7 is a form of bankruptcy that allows you to liquidate your unsecured debt. Common examples of unsecured debts are credit cards, medical bills, payday loans, signature loans, repossession deficiencies, and judgments.

What debts are not dischargeable?

Certain secured debts are non-dischargeable. A creditor is “secured” if it has taken a mortgage or other lien on property as collateral for a loan. Common examples are home mortgages and car loans. If a debtor does not want to surrender his or her home or vehicle the debtor must be and stay current on the loan.

Certain debts singled out by the bankruptcy law for special treatment, such as child support, spousal support, student loans, court restitution orders, criminal fines and most taxes are not dischargeable.
