Few cases are more emotionally charged than those involving medical malpractice. Texas Medical Malpractice Laws
In 2003, the Texas Legislature enacted the Texas Malpractice Liability Act, which substantially affects the rights of patients injured or killed because of medical negligence. These recent laws have strict pre suit requirements and time limitations for pursuing medical malpractice claims.
The 2003 changes also incorporated monetary caps for damages such as pain and suffering and mental anguish. Many Texas Medical Malpractice Attorneys stopped accepting medical malpractice cases after the 2003 changes in the law. Therefore, holding negligent doctors and other health care providers accountable for their actions has become extremely rare in Texas since 2003.
